Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Orbit messaging service (the "Service") at 3133t.net. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age (16 in the European Economic Area) to use the Service. By using the Service you represent that you meet this age requirement and that your use of the Service complies with all laws and regulations in your jurisdiction.
2. Description of the Service
The Service is an end-to-end encrypted messaging application that lets registered users exchange text, files, images, voice, and video. Encryption keys are generated in your browser and never transmitted to the Service in usable form; the Service operator cannot read message contents and cannot recover lost encryption keys.
3. Your account
- You are responsible for keeping your account password and Key Vault passphrase confidential. We cannot recover a forgotten Key Vault passphrase.
- You are responsible for all activity that occurs under your account.
- If you suspect your account has been compromised, change your password from My Account, consider rotating your encryption key, and contact us.
- You may delete your account at any time from My Account. Deletion permanently removes your account, contacts, messages, files, vault, call log, and push subscriptions.
4. Acceptable use
You agree not to use the Service to:
- Distribute content that violates any applicable law, including but not limited to child sexual abuse material, content that incites or threatens violence, or content that infringes intellectual property rights.
- Harass, threaten, defraud, or impersonate other users.
- Distribute malware or attempt to gain unauthorized access to any part of the Service, other users' accounts, or the underlying infrastructure.
- Use the Service to send unsolicited bulk communication (spam) or to operate automated systems against other users.
- Reverse engineer, modify, or interfere with the Service for purposes of disrupting it for other users.
- Resell or sublicense access to the Service.
Because messages are end-to-end encrypted, the operator cannot proactively review content. We rely on user reports for abuse complaints. We may suspend or terminate accounts that violate these Terms upon credible report. Reports may be sent to admin@3133t.net.
5. User content
You retain ownership of all content you create or upload. You grant the Service a limited, non-exclusive, revocable license to store and transmit the encrypted ciphertext of your content solely for the purpose of delivering it to your intended recipients. We do not access, view, or use the plaintext of your content.
6. Encryption and recovery
You acknowledge and accept that:
- The Service is designed so the operator cannot decrypt your messages or files.
- If you lose the device holding your private key and have no Key Vault backup, your message history cannot be recovered by anyone, including us. Generating a new key keeps your account but permanently orphans messages encrypted to the old key.
- The Service does not provide message backups outside the Key Vault you optionally configure.
7. Service availability
The Service is provided on an "as available" basis. We do not commit to any specific uptime, latency, or feature continuity. We may modify, suspend, or discontinue the Service or any part of it at any time, with or without notice.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATOR OF THE SERVICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (c) ANY CONTENT OBTAINED FROM THE SERVICE; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE OPERATOR HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE. IN NO EVENT SHALL THE OPERATOR'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS LESS.
10. Indemnification
You agree to defend, indemnify, and hold harmless the operator of the Service from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, the operator, or third parties. You may terminate your account at any time by deleting it from within the Service.
12. Changes to these Terms
We may revise these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were most recently changed. Material changes will be reflected in the date and may be announced inside the Service. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
13. Governing law
These Terms are governed by and construed under the laws of the State of Florida, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.
